Proposed Bangladesh 'Real Estate Management Ordinance 2008'

The government officials sat with the leaders of the Real Estate and Housing Association of Bangladesh (REHAB) quite a number of times to make the new laws and regulations acceptable to both the parties. The REHAB submitted a set of recommendations to the government for incorporating those in the ordinance. But after the passage of the draft ordinance, it was seen that those were left unnoticed. The REHAB quickly came up with a notice that if the ordinance is implemented, it will destroy the real estate sector, which accounts for around 11 per cent GDP.

Allegations of fraud and deception in handing over plots or flats, and illegal encroachment of private and public land are rife against a section of real estate companies. Many innocent people are often lured by false assurances of hole-in-the-wall housing companies due to lax monitoring of the sector, prompting the government to initiate the move to bring the fast-growing sector under a stringent law.

It suggested that real estate companies must obtain registration from the authorities concerned and get project designs approved under the Private Housing Project Land Development Rules-2004. An occupancy certificate is a must for handover of any plot or flat. The companies must clearly state in their prospectuses the consequences of failure to pay the installments by the buyers, and they must not sell out the flats of defaulters to third parties within 90 days of notification. The draft law stipulates that real estate companies will have to return the entire money along with interest to the buyers in three months' time in case of missing handover deadlines.
The developers have to take initiatives for ensuring utility services in the project areas. If any company is found that it starts the project work without permission, the company will be fined up to Tk 1.0 million and its executives may be punished with three years of imprisonment. It also imposes bar against mortgage of any plot or flat before it is handed over to its owner. Developers will be fined for failing to inform its clients before-hand about the mortgage of any complete or under-construction land, apartment or space. Besides, there will be penalties for not using agreed materials in construction and suspending a project without consulting clients.
The people, mainly the clients of new flats and plots are largely satisfied with the provisions of the new law. They said it might be able to reduce their sufferings to some extent. But it is apprehended that the government might not be able to implement it since the developers are very influential and can dictate terms.
As per ordinance, developers cannot file any case against those government officials who are responsible for supervising the activities of their activities. Yet any official from the developer's side can be fined or jailed for violating any clause of the ordinance. This is highly immoral and contrary to ethical norms, said the REHAB. No good and meritorious person will like to remain in the real estate sector, it added. The REHAB has over 350 members as of now. Besides them, a number of companies are now operating in small scale. The service sector witnessed a rapid growth in the last two decades, employing tens of thousands of workers in construction work and contributing to the expansion of related sectors like cement and steel.
The recent moderate earthquakes that hit Dhaka and adjoining area caused development experts in Bangladesh to contemplate the possible scenario of deaths and destruction in case an earthquake of severe intensity. Thousands of high-rise apartments were constructed almost overnight on hurriedly filled-up ditches and using low quality cements and iron rods in violation of a six-storied limit, imposed by the national building code. The other grim side of the story is that most of the land-owners or real estate developers, to avoid cost escalation, have relied heavily on ordinary masons instead of qualified structural engineers for technical advice while constructing the buildings.
Some unscrupulous real estate developers - certainly not all - usually indulge in all kinds of shoddiness to maximize their profits. A government agency like RAJUK is responsible to oversee the conduct of all real estate developers in the capital city to ensure that they follow the rules and codes and do not cheat the unsuspecting flat owners who would eventually buy them. However, before the draft ordinance goes to the council of advisers for its final approval, there should be a consensus settlement between the government and the leaders of the REHAB on the issues they have differences. Otherwise, the whole real estate sector is poised to witness chaos and confusion leading to its destruction.

Bangladesh Bank Housing Loan Refinance Scheme is now getting response
Bangladesh Bank's Housing Loan Refinance program in now getting responses after the central bank relaxed some conditions of the scheme in May this year.
In May 15, 2008 the Bangladesh Bank has reduced the interest rate to 9 percent from 10 percent and raised the monthly income ceiling of borrowers at Tk 50,000 from Tk 30,000.
Bangladesh Bank in the financial year 2007-08 launched the Tk.300 crore Housing Loan Refinancing Scheme for housing loan. But only Tk.7.79 crore was disbursed by the banks between July 2007 and April 15, 2008 out of Tk.100 crore earmarked for the fiscal period 2007-08.
But on June 30, 2008, the refinancing figure stood at Tk.46.34 crore. According to Bangladesh Bank’s Statistics of the Tk.46.34 crore, Delta Brac Housing Finance Corporation Ltd (DBH), alone disbursed Tk.31.10 crore. The other major lenders are Industrial Development Leasing Company (IDLC) disbursed Tk.4.55 crore, Peoples Leasing and Financial Services Ltd disbursed Tk.3.87 crore and Mercantile Bank Ltd. disbursed Tk.1.11 crore.
According to the revised policy, any person with a monthly income of less than Tk.50 thousands will only be eligible to get the housing (real estate apartment) loan upto Tk.20 lakh from 15 commercial banks and non-bank financial institutions either for buying or constructing an apartment of maximum 1,250 square feet in six divisional cities along with Tongi, Gazipur, Narayanganj and Savar areas.
The scheme has barred government employees and others who are entitled to housing loans from their respective organizations from receiving the special housing loans and if a person has already taken housing loans from a bank or financial institution will also not be considered under the scheme.

Bangladesh Bank has re-fixed interest rate to 9% by reducing 1% on the Real Estate Housing Loan Scheme for the middle and lower-middle income group by a notification.
Failing to achieve less than 20% of targeted 1st years Housing Refince Loan disbursement of Tk.100 crore out of Tk.300 crore scheme for 3 years.
Bangladesh Bank has announced that a person will be eligible for this housing loan who’s monthly income is Tk.50 thousand, earlier what was Tk.30 thousand; maximum loan amount under this scheme will be Tk.30 lac, earlier what was Tk.20 lac and maximum size of the apartment/ flat size could be 1250sft. Repayment time of this loan is 20 years with a grace period of 12 months.
Due to heavy increase in Bangladesh Real Estate construction cost, an apartment costing Tk.30 lac last year has rose to Tk.50 lac at present. Construction material price doubled within a year.
This loan shall be disbursed through commercial banks and housing financing institutions. So, consumers should contact with the commercials banks for availing real estate apartment loan under this scheme.

Bangladesh Real Estate and Housing Industry Scenario
Woes of the housing industry

IT is often said that the housing industry is a fair barometer of the country's economy. Invariably, a successful and thriving economy is represented by a booming real-estate market. A few good examples are Hong Kong and Singapore in the recent past, and India, China, Dubai at present.
This "barometer" has also performed pretty accurately in Bangladesh, or, more specifically, in Dhaka. For certain periods of time over the last ten years, our economy has been prospering, and during that time the housing industry has witnessed a boom. But if one is to asses the present health of our economy, based on the condition of the housing industry, then it can surely be termed "poor."
In the last five years, the members of the Real Estate and Housing Association of Bangladesh (Rehab) constructed the following numbers of apartment units in Dhaka: 2003 - 4465 units, 2004 - 5075 units, 2005 - 5785 units, 2006 - 6433 units, and 2007 - 5800 units.
As we can see, the rising trend of growth was suddenly jolted in 2007. One quarter of the way into 2008, from the unofficial information available, the situation has deteriorated further.
So why is this important sector of our economy ailing? It directly employs about 1 million people, contributes about 15% to the country's GDP, and has provided a lucrative and respectable employment to the country's engineers and architects, which hitherto was limited to either poorly paid government jobs or migration to the Middle East.
Furthermore, the housing industry has been responsible for the setting up of the numerous factories -- cement, sanitary ware, ceramic tile, UPVC pipe, brick, electric cable, and aluminium section -- and has single-handedly revived the fortune of the doomed M.S. rod industry.
The simple answer to the above question is the total apathy of the successive governments towards this sector. Instead of nurturing of the housing industry with encouraging polices and incentives, it has been repeatedly held back by regressive polices.

REHAB get together 2008 held
A get together of Bangladesh Real Estate Developers (REHAB- Real Estate & Housing Association of Bangladesh ) held on Wednesday, 09 April, 2008 at Bangladesh China Friendship Conference Center, Dhaka, organized by the newly elected 11 REHAB member organizations.
Eng. Tanvirul Haq Probal, newly elected President of REHAB told the gathering that now the election is over, so, there is no separate panel, henceforth there is only one panel that is present Executive Committee of REHAB comprising all members. We shall build tomorrows REHAB unitedly.
After long 19 years of establishing REHAB an elected Executive Committee is formed, thus, the mood of festivity perceived in every body at the get together.

Real Estate and Housing Association (REHAB) biannual election held on Saturday, 29 March, 2008. This is the first-ever election of REHAB prior its inception in 1992. Previously all the executive committees were made on selection basis. Nobodhara Panel won 11 seats leaded by Eng. Tanvirul Haq Probal, Managing Director of Building for Future Ltd. and Green Panel leaded by Mr. Mokarram Hossain has got 10 seats.

A total of 42 candidates were competed for 21 members of the executive body, who were elected by the association's 361 members.
REHAB, the apex trade body for the Bangladesh Real Estate Developers, was established with only 11 members in 1991, which aims to promote private sector housing.

Government of Bangladesh is going to enact Bangladesh Real Estate Law 2008.
To stop forgery and harassment of the clients in the Real Estate Sector, Government of Bangladesh is going to enact Bangladesh Real Estate Law 2008 with provision of Compensation or Penalty and/ or cancellation of license. Secretary, Ministry of Housing and Public Works informed that a draft law is already prepared and discussion on this primary draft held in the ministry on March 3, 2008. He also informed that after finalizing the draft in the ministerial meeting on March 10, 2008 it would be presented in the meeting of the Advisory Council of Bangladesh.
This law enforces Real Estate concerns of Bangladesh must have to be registered; only the registered concerns will be allowed to do real estate business in Bangladesh. It will be easier for the govt. to take stern action against the real estate concerns if complaint against any of them lodged.
The Secretary told the newsmen that by enacting this law discipline in Bangladesh Real Estate Sector would revive; at present there is no discipline in this sector.

REHAB fair in Chittagong from Jan 17, 2008
A three-day Housing and Real Estate Fair begins in Chittagong from January 17, 2008.
The Chittagong chapter of Real Estate and Housing Association of Bangladesh (REHAB) is organizing the fair for the second time at the auditorium of Institute of Engineers Bangladesh.
Around 41 real estate firms from Dhaka and Chittagong will participate in the fair to display their offers at 45 stalls, said the organizers at a press conference at Chittagong yesterday.
Convener of REHAB Chittagong chapter Kazi Ainul Hoque said the participating firms will offer special discount and attractive gifts to their customers at the fair.The price of ticket for a day has been fixed at Tk.20/-, and Tk.50/- for three days, he said, adding that the proceeds from the ticket sales will be donated to the Sidr victims.
